- The contract shall be binding on two
parties viz. Buyer and the Company. The Company will take all necessary
steps for the performance of the Company's part of the contract.
- Price:
The prices quoted overleaf are on Ex-Mill Basis. The prices are exclusive
of Central Excise, Sales Tax, Provincial Tax and/or any other govt.
levies applicable which shall be charged to the buyer's account irrespective
of the rates confirmed in the confirmation note. The rates ruling at
the time of despatch will be charged.
- Sales Tax:
The Company is registered under the Central and Vat Act., Tax Identification
No. 24250701385 dt. 1/7/02 and C.S.T. No. 24750701385 dt. 29/01/96.
- Term of Payments:
Overdue Interest @24% p.a. shall be charged from due date.
- Delivery:
- Delivery of all goods may be made in one or several lots.
- Such delivery made against an order shall be deemed to be complete
as soon as the goods are delivered to the carrier.
- Arrangement of carrier is buyers responsibility and risk.
- Cancellation of order:
- After confirmation of order by the company, buyer must intimate
any changes or cancellation of part or whole order within 24 hours
of the acceptance by the company. However company reserves right
to cancel the order in full or in part without giving an explanation
for such act of the company at any given time before the performance
by the company.
- Orders are liable to cancellation either in whole or in part when
performance becomes impossible by reason in force majore.
- Complaint:
No complaint will be considered unless submitted in writing and received
by the Company within 7 days of arrival of goods at the destination.
No complaints shall be entertained on converted material.
- General:
- Transit insurance @0.2% is applicable unless otherwise specified
in writing.
- The Company accepts no responsibility for any loss or damage beyond
the point of despatch.
- Transit is entirely on Buyer's account.
- Standard Atmospheric Conditions:
A relative humidity of 65% ± 2% and temperature of 27° C
± 2 will be taken as the standard atmospheric condition for the
purpose of testing.
- Conditioning:
A suitable room or chamber is required for conditioning samples. Specific
temperature and relative humidity, as specified in A.6.1 above, should
be uniformly maintained throughout the chamber. Samples should preferably
be suspended so that the conditioning atmosphere has free access to
all its surfaces. The samples will be deemed to be conditioned when
the results of two weighing, at an interval of not less than one hour,
do not differ by more than 0.25 per cent of the total weight.
After the samples are so conditioned, they shall be touched and/or handled
as little as possible and tested immediately.
- Tolerance of Grammage:
The average of test results shall not differ from the nominal grammage
by more than ± 5%. The highest and the lowest readings will be
ignored.
- Tolerance of Burst Factor:
Results of tests made on different samples from the same consignment
or results of tests made on different instruments are expected to agree
within ± 5%.
- Making Orders:
An order shall be deemed to be properly fulfilled if the quantity supplied
is ± 10% of quantity ordered.
- Jurisdiction:
All disputes arising out of this contract shall be subject to Pardi
Jurisdiction only
